Scotland - Licensing Board defers hearing on police failure to disclose evidence

Angus Licensing Board has adjourned a Review application against De Vitos nightclub in Arbroath brought by Police Scotland, which was due to be heard at its meeting on 12th February 2014.

The move to adjourn followed criticism of the Police complaint which was referred to as being “invalid” due to its lack of detail. The complaint highlighted 53 occasions where the Police had attended at the premises in 2013 albeit without even specifying the dates or nature of the incidents.

Further, it was put to the Board that a request for additional information in relation to the incidents had been made last month but nothing had been received.

The deferral was made to allow the Police to provide further information in respect of the 53 incidents, one of which is to go before the Sheriffs’ Court shortly.
