Hospitality businesses and insurance companies confirm intention to appeal in business interruption case

Several hospitality businesses and insurance companies have signalled their intention to appeal a High Court decision in relation to their business interruption insurance policies and Covid-19 to the Supreme Court.

Mr Justice Butcher, the Judge who heard the case has been presented with additional arguments on behalf of both the hospitality businesses and the insurers. All of the parties have until mid-January 2023 to submit applications for appeal and if those applications are successful, a preliminary hearing in the Supreme Court could take place in late 2023.

The disputes relate to the wording of various business interruption insurance policies and if, how, and in what amounts insurers will need to pay out.
