Gaming - DCMS postpones Gambling (Licensing and Advertising) Act 2014 - important consequential update

29 Sep
2014

Further to our item just last week about the postponement of the implementation of The Gambling (Licensing and advertising) Act 2014 until 1st November, an important point needs to be emphasised and has been pointed out by the Gambling Commission and that relates to the date action MUST now be taken. The GC has issued a circular stating as follows;

"As a result of the change in the date of commencement, it is anticipated that the transitional provisions will be extended and advance applications for a continuation licence will be able to be made to the Commission up to and including 23 October 2014.

This means that operators who are currently able to provide facilities for gambling in Great Britain (because they are permitted to do so in an EEA or white-listed jurisdiction, or Gibraltar) will be able to continue to do so after the Act comes into force and pending determination of their applications provided they either submitted their application, with the relevant application fee, by 16 September or now do so before midnight on 23 October."

It is therefore vital to take appropriate action by 23rd October and not leave it beyond that time even though implementation of the Act has been postponed until 1st November.

Law correct at the date of publication.
